82% of republicans voted for the civil rights act of 1964 vs. 64% of democrats. And lets see, first black Supreme Court Justice Thomas Clarence, nominated by Bush Sr. The first black Secretary of State, Colin Powell nominated by our current President Bush. The first woman ever Secretary of State who is also African American, Condi RIce. Wow, with numbers and facts like that it's no wonder democrats hate history. They don't people to look back and learn the truth.

I would argue the the premise is false. And you've got 2 "C" answers.

I usually see 3rd party candidates on elections. Have for decades.

But let's assume the premise is true. It can't be All of the Above, because "liberal ballot access laws" would mean more candidates on the ballot, not less.

I would really pick "the legal institutionalization of the two major parties" Both in terms of media coverage and also in terms of ballot access laws. As a libertarian, I know the Libertarian Party has struggled with unfair ballot access laws, precisely because the laws are written mostly to cover the 2 major parties.

Well, they vary state to state a lot. One great site is Ballot Access News. They and the Committee on Free and Open Elections try to end the very restrictive ballot access laws.

What it is based on is arguable. Technically often a percentage of voter registration or those who voted in general elections recently. Many times, though, they are arbitrary numbers and even the percentages above can often be arbitrary.

This is because it sets nomination rules outside the US, regulate the conditions under which a candidate or political party is either entitled to stand for election or to appear on voters' ballots. Laws restricting which names may appear on the ballot have an obvious impact on the civil rights of candidates and political parties, but such laws also affect the civil rights of voters.
