The rules for the conduct of Parliamentary elections are set out in Schedule 1 to the Representation of the People Act 1983. All that is stated there about what a voter should do is"The voter, on receiving the ballot paper, shall forthwith proceed into one of the compartments in the polling station and there secretly mark his paper and fold it up so as to conceal his vote, and shall then show to the presiding officer the back of the paper, so as to disclose the number and other unique identifying mark, and put the ballot paper so folded up into the ballot box in the presiding officer’s presence."
So it would seem to be an offence to not comply with those rules, though it is not stated anywhere what the penalty is.
Section 65 of the Act states:
"A person shall be guilty of an offence, if, at a parliamentary or local government election, he—
...
(e) fraudulently takes out of the polling station any ballot paper"
The penalty is stated in section 65(4) to be a fine not exceeding level 5 on the standard scale (currently £5,000) or six months' imprisonment or both.
The key word is "fraudulently". What that means in any particular case is a matter for the court! But the clear meaning of the section is that non-fraudulent removal of a ballot paper from a polling station is not an offence.
