Unless the courts decide to ignore ALL the legal precedence set forth by the federal courts on the issue of gay marriage and reinterpret the US Constitution on their own (which they have no legal authority to do) then it wont get overturned.Prop 22 and Prop 8 had/have 2 diff legal challenges.
Prop 22 was a legal challenge within the state Constitution and the State Courts have legal authority to interpret that.
Prop 8 is a challenge in terms of the US Constitution and so the courts have ZERO authority to interpret the US Constitution.
They will have to rely on cases that have been decided already by the federal courts.
Every case involving the legality of defining marriage as btwn one man and one woman in the federal courts have ruled that defining marriage this way does not violate anyones US Constutional rights.
