New Jersey Election Ballot

Lester Said:

What if Leo C. Donofrio wins his case ?

We Answered:

What would happen is stated in the Constitution. However, the SCOTUS has to first decide if the geneal election was legitimate. The Constitution says nothing about voting for someone inelegible. It only states that someone who is not a natural born citizen cannot hold the position of President. The SCOTUS would have to determine if these people have caused the election itself to be invalid. If so, they can order a new election. That would be extreme and would cost millions. I doubt this would happen.

The Constitution says that state electors actually vote for President, NOT the people. So the election actually didn't take place yet and this is why I doubt the SCOTUS will order a new general election. What would happen is that the electors (in the electoral college) can vote for whoever they want.

Here's a little bit of trivia. If someone NEW gets 270 electoral votes, they are President. In order for this to happen, there would be a mini-election in trying to get electors to vote for them. I'm betting both main parties would front another candidate.

But what is more likely to happen is that no one gets the required 270 electoral votes. In that case, the House will vote on who they want for President out of the three people that received the most electoral votes. And the Senate would choose out of the 2 people that received the most electoral votes for VP (each senator gets one vote). For the Presidential vote, each state in the House has only ONE vote. So if a state delegation is split 50/50, they don't vote unless a member of the delegation breaks with their party. Majority of each state's delegation decides which way to cast their one vote.

So Electoral College will vote.
If someone gets 270 votes, it ends there.
Otherwise, the House and Senate pick the President and VP.

Another scenario that is also likely is that the SCOTUS could force the electors to vote as normal, but declare the candidates ineligible. The Constitution says that when someone is unable to perform their duties as President, the VP is to take over. So Biden would be President in that case.

Will someone explain absent tee voting to be i don't understand the process?

We Answered:

in california post mark doesnt matter ...it has to be recieved by election officials prior to polls closing here in cali.
I always vote absentee because it is far easier to sit down with and take my time going through the propositions at the kitchen table with all resources handy then scrambling in the voting booth.
BTW mailed mine in over a week ago to be safe.
