Judge Sparks, appointed by the first President Bush, ruled that although Mr. DeLay was free to withdraw, the Republicans might not remove his name from the ballot, because the Constitution's sole residency requirement for the House was that a candidate "when elected, be an inhabitant of that state in which he shall be chosen."
No one could yet say where Mr. DeLay would be living on Nov. 7, the judge said. To allow such a ballot change would give Democrats an illegal disadvantage, he added.

"Political acumen, strategy and manufactured evidence, even combined with a sound policy in mind, cannot override the Constitution," Judge Sparks wrote.

He cast doubt on Republican evidence, noting that Mr. DeLay sent a draft of his letter announcing his move to Ms. Benkiser for editing.

Texas law prohibits the replacement of names on the ballot except under narrow circumstances to prevent parties from seeking advantages by suddenly switching candidates

In Chicago, the number simply acts as a code to activate the machine. And you're right, it's just a number that can only be used once. The card is recoded before the next voter uses it.

It is not cross referenced to your application for a ballot. Which is the only way it could be used to identify you.

What goes on in other places, I can't say.
