Election Commision Of India

Jimmie Said:

what is the procedure for removing the election commisioner of india, please mention your source also,?

We Answered:

I thank "Insomni.." for the elaborate details that supplemented my collection from the news reports.. But I have some corrections to his info.. as well as differences to express with his learned perceptions..

The respondent has said that the CEC took a whole year to give his recommendation.. while the CEC himself recently clarified that the petition of the MPs was sent to the accused EC after the Karnataka elections (with which the Commison was busy) in July 2008 and the latter gave his replies only recently, after six months of service of the reference for his remarks.

Also the fact that he received the petition of MPs in his chamber does not appear to be "curious" unless one takes a blatantly paranoid view of the whole thing.. Because the petition was a complaint on one of the ECs and it would have been inappropriate to collect it before the full commission..

As a senior IAS official the CEC would not have been that naive to decide the course of action crudely unless he had solid conviction about the propriety of such an action..

As far as I gathered from news analysts, the Constitution seems to prescribe a recommendation of the CEC on a petition for dismissal of an EC.. and the further prescription to have it "routed through proper channel" to him seems to be an imposition of the apex court based on its interpretation of the spirit of the article rather than so specified in the Constitution itself..

For a political appointee like Mr Chawla is unlikely to be let down by the political set up, just as we saw when the MPs petitioned the President even when he was proposed for appointment to the sensitive post.. The petition was not forwarded to the CEC at all.. Is not the spirit of the Constitution defied in such a scenario..? Evidently earlier court verdict had overlooked such situations while giving its earlier well intended verdict..

That Shah Commission indicted the official and he was wallowing in a host of controversies and escaped all the consequences only due to political patronage earned by him contrary professional ethics.. and the political associations of his family Trust were no secret, are points glaring enough to decide a dismissal by the President with the concurrence of the CEC..

But the CEC is reported to have taken a decision on the basis of the uniformly partisan interests taken by his colleague under his own nose, which stood to justify the serious doubts expressed by a large number of MPs in their petition.. rather than based on his infamous service record..

A doubt was raised in one of the newpapers that what appeared to be partisan in the eyes of the CEC could well be considered as well meant alternate view by others.. The normally well informed citizen could easily see through the game.. Would it be difficult for a seasoned administrator like the CEC to see through a uniformly favoured view to a party and "well intended alternate view"..?

While you are all ready to wink at the dubious track record of a person in sensitive post (indicted by not less than one from Judiciary) for serious misuse of authority etc.. , you wish to raise all drab technical loop holes to pull down an upright offcial deciding for the fair functioning of the institution..!!

For all of you, to pull down BJP seems to be more important than ensure the dependability of the prestigious Election Commission..

It is nearly settled that the President would put the recommendation in cold storage (or dust bin?) as she herself is more a political appointee rather than an outstanding citizen known for any national sacrifice or merit..

The basic perversions developing in public life do not seem to augur well for the future of the country.

God bless.

It needs more connections between the sentences. They are like short statements separated from each other.

Just some corrections.

The Korean War (capitalized) was a conflict between North and South Korea from June 25th, 1950 until (intill is not a word) July 27th, 1953.

It started when the United States asked the United Nations (capitalized) to settle the issue of a divided Korea.

The United Nations commission (not commision) voted for elections in Korea.

The South boycotted it and refused to allow it in the North.

The South became independent and elected a president.

On January (not January) 5th, 1950, the Secretary of State (capitalized), Dean Acheson, speaking at the National Press Club, articulated the American policy, he spoke about (more correct) the countries the U.S. would defend, not including Korea.

This convinced the North to unify the country by force and they struck in June.

It ended when with the UN's acceptance of India's proposal for a Korean armistice, a ceasefire was (ws?) established on July 27th, 1953.

North Korea and the U.S signed the Armistice Agreement.

It still needs to be rearranged and structured.

the north invaded the south first then general eisenhower from ww2 went into south korea and with his troops pushed the north koreans all the way up to china, china then helped north koreans push the south back down to the border between north and south korea, now thats the dmz on the 38th (i think) parallel where guards are ready for action at any time, and theres always two guys staring at each other 24/7

ALSO - the two guys thing, theres still people there taking shifts staring at each other, the conflict is not over, and i think those dates are a little off, it was a little earlier i believe
