Not sure exactly where to start, but the Tea Party is against bail outs of all kinds. They tend to be for a restorationist interpretation of the interstate commerce clause in which the federal government's only role in "regulating interstate commerce" would be striking down barriers to trade erected by state governments against other states. Also, as said above, Nelson claims not to have read the bill. The Tea Party has been consistent, even if they have been annoying, on that point.

Restoring the intended scope of the interstate commerce clause would bar the federal government from socializing the losses of large forms by both eliminating the lender of last resort (the Federal Reserve) and eliminating Congress' unbounded authority to apply tax payer money to whatever they deem necessary and proper to the general welfare of their political aspirations.

That said, the "reform" bill doesn't actually solve the heart of the problem. If a firm follows the regulations to the letter and the funds raised by the firm's assessments are insufficient to cover the losses, guess who's on the line...the tax payer. The central flaw is that Dodd's bill continues bailouts as federal policy, despite his claim that he's ending 'too big to fail.' ...It wouldn't bring stability to our financial system, but further erode market discipline — while asking us to put all our faith in the same regulators who have failed repeatedly.

The Senate bill, sponsored by Democrat Chris Dodd, claims to subject all "too big to fail" institutions to greater federal supervision, but in fact it only mandates such regulation for bank-holding companies. Regulators would have to make a case-by-case decision on whether to apply it to other financial companies.

That's no minor oversight, because insurance companies, like AIG, tend to have thrift charters rather than bank charters. So, as the bill stands now, AIG and other insurers that accepted massive bailout funds, such as The Hartford, would not be automatically covered. That's a head-scratcher only if you forget that most insurance companies reside in Dodd's home state, Connecticut.

Deep in Sen. Blanche Lincoln's (D-Ark.) bill, passed by the Agriculture Committee last week (it will be merged with the Dodd bill), are exemptions to rules mandating transparency in the trading of complex financial derivatives, such as the credit-default swaps that figured so prominently in the Wall Street meltdown. One of the most troubling is Sen. Debbie Stabenow's (D-Mich.) amendment that would exclude the captive finance arms of certain manufacturers from the bill's requirements that derivatives only be traded over exchanges and through a clearinghouse. Only a handful of firms would be excluded — chief among them, of course, the automakers.

Simply letting bankrupt firms go bankrupt would be the most effective deterrent to excessive risk taking. Lehman's failure proved that bankruptcy is the appropriate avenue for firms that take excessive risks. We know none of Lehman’s counterparties failed as a result of Lehman’s failures. Just as we know none of AIG’’s counterparties would have failed if they did not get 100 cents on the dollar from their CDS positions. There was no reason for the bailouts in the first place.

By the way, Ben Nelson works for Warren Buffet.

Didn't see where her party affiliation is mentioned in the article. It was in 2004, so who knows why she did it.
