Homosexual can marry like any one else in California provided they adhere to the statutory provisions of the law. They can not marry relative closer than first cousins, people who have not reach majority or lack capacity, married individuals, or members of the same sex. (just a few of the statutory restrictions).

Can you explain why you believe the courts should be able to strike one of these provisions but not the others. This isn't an issue of a protected class, this is an issue of the actual definition of marriage. Marriage has always required 2 people of opposite sexes. It is you and others of your stripe that are attempting to change the law and force others to live by your desires. Why do you believe it is okay for you to impose your will on an unreceptive society.
