Complete judgment of the District Court has to be checked to ascertain on what ground (relating to jurisdiction) the court refused to decide the divorce petition. The fact this case related to which Matrimonial Indian Law (religious or Civil)? What the enactment under which this marriage & matter relating to it are covered states about the Jurisdiction of the court? Where in India both parties last resided as husband & wife & for how long, whether that period will constitute "last resided together or not"? Now all such matters have to seen after going through the judgment of the district court then only a correct legal advice can be given for moving the High Court against the order in Appeal or Revision as the case maybe, don’t expect that can be provided by anyone from this forum.
